People dress like fools everyday, a pirate costume is no more retarded than what most kids are wearing. Its evident that the people bothered by this have doubts about their religion, as well they should. If I was his parent i would demand the suspension be lifted, or insist that clothing bothersome to my child (jesus is my homie, shirts with idiotic bible phrases on them, etc) be banned as well.
