If this lady has an unsecured or WEP secured connection, it’s completely possible someone might have used her connection (as you can crack WEP in less than 60 seconds using packet sniffinf and ARP cache poisoning techniques), however if she had a WPA-PSK secured connection, she is most likely lying, as I’m not aware of any vulnerabilities in the protocol currently.

She is likely to pay nothing if she gets a lawyer. Current case law is that IP address is not sufficient to establish ID. If they cannot link her directly to the downloads then they cannot fine her anything.

Sharon, I think ‘who can believe the words of a thief’ was used ironically. In the next phrase, the article explains that the case isn’t ‘slam dunk’. I don’t think anyone is seriously calling her a thief (apart from the accusing party in the trial, apparently).

Like the guy who invited BT to take him to court, over a bill for a premium rate numbers scam. After pointing out that a law to combat money laundering the proceeds of crime, would mean they were rendering themselves liable for a charge of accessory after the fact.
